In its judgment of 3 July 2012, C-128/11, the Court established that "the right to distribute a copy of a computer program is exhausted if the copyright holder who has authorised, even free of charge, the downloading of the copy onto a computer medium via the Internet has also granted, in exchange for a payment aimed at allowing him to obtain remuneration corresponding to the economic value of the copy of the work of which he is the owner, the right to use the copy itself, without limitations as to duration".
